“Modesty Creek Road near Anaconda is, in fact, a county road that should be open to the public, according to a Butte attorney hired to research to the claim.
Susan Callaghan delivered her opinion Thursday to commissioners, Chief Executive Becky Guay and County Attorney Joan Borneman, stating there is enough evidence to show the county owns the road.
The commission will vote whether to reaffirm Modesty Creek Road as a county road at its next meeting, 6 p.m. March 6 in the courthouse courtroom. Until then, the decision is not final.
Residents and sportsmen have long contended they should have access to Modesty Creek Road, a stretch of which is currently blocked by a pair of landowner gates heading east to Dry Gulch.
If now approved by the commission, the road would open all the way to where it crosses with Forest Service land.”
