State takes landowner to court over locked gate

“An access dispute over Tenderfoot Road in the Little Belt Mountains escalated on Friday when a lawsuit against Howard Zehntner and Zehntner Brothers LLC was filed on Friday in Meagher County District Court by Montana Attorney General Steve Bullock.

The state is asking the court to remove a gate across the road to ensure access to thousands of acres of public land. According to the complaint, on Aug. 30 Zehntner ran an ad in the Meagher County News stating that access via the road was walk-in only.

This was after the county and state asked Zehntner to remove a padlock from another gate. According to the suit, Zehntner then erected another gate farther down the road in August and padlocked it.”
